Terralpina terms of sale

Terralpina designs and develops outdoor mountain trips, described on Terralpina ltd. marketing tools. Our packages include lodging and guiding services, along wil all other secrvices specified in the product you selected.
Contract Agreement
Once Terralpina has confirmed a costumer’s reservation –previously made by phone, electronic mail or in writing – a contract is created between Terralpina and the costumer himself, with its corresponding rights and obligations. Should this costumer make a reservation for a third party, Terralpina Ltd will only validate the reservation by creating another Terralpina contract, therefore involving the parties new rights and obligations (this particularly refers to the payment of the package trip). These terms and conditions apply to all costumers who signed up with Terralpina Ltd.
Payment and subscription
By subscribing to a Terralpina package trip, you automatically agree with the Sales Terms and Conditions of the Swiss Federal law, voted on June 18th,1993(similar to the French law defining sales terms and conditions of package trips voted in July 13th, 1992).
A 30% deposit, or total trip price must be joined to any subscription formular for reservation made at 30+days. Balance is due at 30- days of trip starting date. Should you not respect payment deadlines, Terralpina Ltd. reserves the right to cancel trip. A written confirmation is sent to your address – in writing or by electronic mail - to confirm your participation to the trip.
Price
Unless mentioned otherwise, Terralpina’s package price include organization and guiding services and expenses, transports (taxi, bus, ski lifts if anyetc.), food and lodging from trip beginning to end. It does not include costumers personal and travelling insurance, return plane ticket, airport taxes,and personal expenses during the trip (i.e. souvenirs, drinks ...). Any unplanned and imposed additional expense for the trip is paid by trip participant.
Due to market fluctuations, and if increase or decrease in currency rates, transportation and/or other locally hired services occurs, Terralpina will increase trip prices if increase equals 5 % of the price or more. Our prices are based on the US Dollar exchange rate and/or the country's currency rate of the trip, at time of Terralpina's publications.
Responsibility
Terralpina’s product description and presentation is based on trip information available at time of publication. We will not be held responsible for airplane being rescheduled or delayed, due to strikes or other reasons.
As a traveller, you have responsibilities to Terralpina Ltd., vacation facilities and other travellers that include: Selecting a trip appropriate to your interests and ability and being in sufficient health to undertake the trip. Preparing for the trip by packing appropriate clothing and equipment, acting in an appropriate and respectful manner and in accordance with the customs and laws of the country or countries in which you are travelling, respecting your guide's decisions and advice once on the field, making the guide aware if you feel unable to participate in a particular activity for any reason and to decline to participate, being aware of the isolation aspect of some of our trips and consequences involved. It is the responsibility of the traveller to read and obtain complementary information from Terralpina website with regards to activity difficulty levels, trip destinations and travelling documentation requirements. Terralpina Ltd. will not refund you for the trip if you are enable to travel due to a lack of preparation from your part at time of trip departure. It is the traveller’s responsibility to subscribe proper insurance policy with travelling facilities.The contract existing between you and Terralpina Ltd. is exclusively governed by the Swiss commercial law.
In accordance with current legislation, Terralpina has a professional civil liability cover. However, it is the responsibility of travellers to subscribe personal civil liability for the trip.
Comprehensive Travel Insurance
We strongly advise you to subscribe to a comprehensive travel insurance, even though most credit cards provide this type of service. Because we care about your peace of mind, travel protection with Winthertur will be offered at the time of reservation and included on your tour invoice. This insurance is perfectly adapted to our trips' profile, and represents 3,4% of trip price. Should you cancel your trip unexpectedly, a travel cancellation insurance is also offered: its price is 2,6% of the trip value. Comprehensive travel insurance are due and will come into effect once balance of the total price has been paid. Terralpina will send you a detailed copy of your insurance contract once you subscribe and/or on demand.
Trip Cancellation (charges)
Cancellation must be made to us by phone or electronic mail; if you must cancel your reservation, your cancellation fee will be determined under the following formula:
- 30+days: only a 50€/pers (75 Swiss Francs CHF) fixed amount will be charged for filing expenses.
- 29- to 21 days: refund 75% of trip price
- 20- to 8 days: refund 50% of trip price.
- 7- to 2 days: refund 25% of trip price
- 2- days: refund 10% of trip price.
No refund will be made, if you are not present at meeting time and place of trip start, or if you decide to interrupt your participation to the trip by your own doing. In addtion, it is the guide's decision and responsibility to ask a participant to cancel the trip due to serious physical or technical difficulty, putting group safety at risk. No refund will be made in such a case.
If Terralpina decides to cancel the trip (i.e. lack of participants), you will be informed at least 21 days before trip starting date, and full refund will be made to you, without any additional compensation.
Should Terralpina cancel a trip, refund will be made according to number of days cancelled and corresponding trip expenses. Unforeseen circumstances and/or weather and snow conditions, participants’ physical exertion and/or disability may occur during the trip. Should these features put the group at risk, Terralpina's guides reserve the right to alter trip itinerary (i.e.: travelling dates, and schedule, trip route, guiding assistance etc.). These changes do not imply any type or refund and/or compensation from Terralpina Ltd.
